I hold empathy the atrocities committed against Aboriginal people. However, the relationship between the U.S.A and the sovereign nations within U.S.A. borders bears review. Specific land area entitlements and independent rule are just reasonable and, fair. However, reaping the benefits of sovereignty when most advantageous and U.S.A. citizenship when most advantageous is not just. The projected end game of using capital acquired from U.S.A. business enterprises to purchase more land to be taken off U.S.A. tax roles would ultimately result in the sovereign nations owning the entire country. That is not consistent with fairness or equity. Neither is ancestral or sovereign rights to harvest wildlife using non-ancestral technology. To further complicate this unique relationship is blood line purity. Are there specific DNA data points that would make one person aboriginal and another not ? Mixed marriages are both common and inevitable. The Aboriginal people abused, as well as their abusers, are no longer alive. When a sovereign nation person takes fish and game it is called subsistence. When a U.S.A. citizen takes fish and game it is called sport. The lack of equity here is glaring. It is not my position that Aboriginal peoples not be allowed to use the transportation, health, sanitation and technology created by non-Aboriginals. It is my position that each of us pay our share of the cost, regardless of ancestry.

Very inciteful article Jeff! It comes down to power and control. Right now the courts have been siding in the favor of water rights being included in treaties in other areas of the state. Everyone wants a piece of the pie but eventually the slices will run out and the courts will likely decide in a different direction. Agree with Eric, we are all Americans. Most areas of the world have tossed out birth right ownership as it is inherenty wrong however in many parts of our country our American Indians still suffer excessive hardships....not so much in Washington State. Looking forward to ending all this corruption in our system some day. Hopefully our newly created D.O.G.E. will start fixing this mess in the upcoming year.

In 2018, the Department of the Interior, under the Trump administration, took Mashpee Wampanoag (tribe) land in Massachusetts out of trust. This marked the first time Native land has been taken out of trust since the "termination era" of the 1040's-1960's.

And, it is just a small amount of unkown take down efforts that "water" down Clallam County resources and neutralize the rights and priviledges of 78,000 for the benefit of 217. Balance should be a goal as should keeping United States Soventry sovern.

Jeff, another great article. Thanks for getting in the weeds on this. What's interesting is that the last 3.5 years, before retiring, I worked for the Portland Water Bureau. The Federal Government, State Government and Local sources of funding were used to "Enclose" all the reservoirs due to "Security Concerns" about possibly getting poison into the water sources of Millions of Portland OR Inhabitants. This was "Required". We ended up enclosing very large reservoirs with concrete ceilings. How is it that new reservoirs can be open and accessible to nefarious individuals who may want to harm challah county residents? Just another angle.

The county employee's should be concerned. The leftists government in power would drain the funds and hand things over to the non-profits and tribes.

Take a look at what they just did, and have been doing for 14 years.

I can’t even get thru this with out cursing…. GD SOB’s. I lived on S Fla and the Keys in the 60’ through mid 80’s and watched and felt the strong arm of so called “environmentalists”. I shake at that memory….. we are really going to have to energize and rally against this …. This involvement of the trib the ICLEI has to stop!!!!!!

While I would expect that any reasonable rational Individual with the slightest interest in the wellbeing of the community here in the Sequim area would be VERY angry in the way the local Americans wishes are being completely ignored and overridden by the usual few criminals and corrupt organizations who could obviously care less what the will of the local folks is, this is really an outstanding example that folks of all communities across America should pay strict attention to~! This my fellow Americans is a prime example of just how evil and completely corrupt a "straight democracy" ALWAYS is~! Not "sometimes" but ALWAYS~! The mob never really rules in a straight democracy because the most powerful and wealthy "elite" ALWAYS control things well beyond the will of the people, and usually so cleverly that the average Individual has no clue that they are even slaves to the evil system of the elite. I do hope that this sounds familiar to everyone reading my humble words. This is precisely why America is not now, nor has it ever been, a straight democracy and The Founding Fathers & Mothers always knew that so they created the first true "Democratic Republic" where the will of ALL of the people is respected~! So, when these criminals in the mainstream media and government scream that their "democracy" is at risk, what they are really saying through their doublespeak "word crafting" is that THEIR fake government and evil masters want you to become their "useful idiots" by foolishly defending their criminal enterprises that were never ever intended to be part of the American experience~! We have one great opportunity to help the new incoming federal administration to put an end to the criminals of humanity and their evil "democracy" of the elite, so that we can regain our lawful American Democratic Republic. It may actually be our last opportunity because the advances in real science and technology that is available to these criminals of humanity is well beyond what the average American now understands, and the criminals would be extremely difficult to eliminate if they are allowed to continue with their evil dastardly agenda~! Make no mistake, these are absolutely critical times for ALL Americans to put aside their foolish issues, and to come together as one powerful force to secure our country and the freedoms that we all want for ourselves and all future generations~! Excellent, Jeff! It is obvious that we have had, have, and will have enough water for a long, long time.

This area was once covered with an ice sheet and a glacier, so logically, water is plentiful. Unscrupulous people are making concerns into dire situations for their own benefit. I am still trying to understand how outside entities, in this case foreign countries, can be so influential with our water rights. Besides FEMA shouldn't other federal agencies be included in this process so that foreign interests don't overtake our own county's interests?

Yes, I'm working on the reservoir project with SEI-US. I can't speak on behalf of the rest of the article, but I can note a couple other things.

One is that the streamflow projections contain that disclaimer language because they are not direct predictions of streamflow on a particular day. Meaning that the data cannot accurately predict the flow precisely for April 7, 2044 (for example). Rather, it tries to capture both the random variability of weather plus the effects of background trends over time (generally, but not always, more winter precipitation falling as rain, earlier snowmelt, etc). There are even ten different sets of predictions used. These are all looked at together to capture the reasonable range of conditions we can expect. This is common practice in this field. Can we precisely predict the flow on a given day in 30 years? No. Can we make a good guess of the expected range of future conditions? Yes. The goal here is to be able to test if the reservoir would provide its benefits to agriculture and fisheries over the course of its lifecycle, looking forward the next 50 years.

The other note is that I've worked here for 6 years and I've never even heard of ICLEI until now. I was hired because of my specific knowledge in calculating water models. In fact, our org's rates are pretty competitive compared to other firms in this field if I say so myself- great news for taxpayers!

Jeff thank you for all your hard work, research and knowledge of our local governmental situations. More and more it’s urgent we as residents get & stay involved in our local politics, meaning local government and the politics that influence our local governement(s). All I can think of right now is Ozias and his mighty mouth and the sword he yields in this County. His influence and power being used for yes his most generous donor.. All of it has Jamestown Tribe written all over every aspect of the Dungeness/Sequim Valley. It is never more evident & permanent than the totem pole at City Hall there to remind all of us exactly who is in control. Mr. Ash is correct, it will take a coalition to fight forward, we can’t expect 3 minute public comments every week, petition signing and a few letter writers to fight fight fight these wars, they are not battles. The entities pushing this crap are good at what they do WE HAVE TO DO BETTER AND BE SMARTER. There are losers and winners & so far we have not been the winners.

Jeff, I thought I'd share my letter to FEMA

#1 - With the goal of transparency, any Dungeness Reservoir Work Group should be open to the public to  hear what is being discussed. Without actually hearing what is discussed, impacted citizens cannot adequately formulate concerns they would like FEMA to address.

#2 - Is there a model that predicts the worst case scenario of a reservoir breach during a time of high river flows? Has a flood map been prepared that depicts flooding models? Without such a map how can potentially affected residents act to protect themselves with physical barriers, and insurance? With respect to physical barriers, will any resident who falls within the flood zone be able to carry out a mitigation plan without needing to obtain county, state, or federal approval(s)/plans?

#3 - There are too many entities involved in this project without one being singled out as being responsible to manage the project. Coordination, or the lack thereof could lead to cost overruns, or even a catastrophic event. Who has the ultimate say in this project, and are they beholden to public disclosure rules so that the public may stay informed? No entity should be able to make a unilateral decision, or take action, without the approval of the sole project coordinator, unless such a decision has been granted by the coordinator. The sole project coordinator shall maintain all files on the project that each contributor shall provide, and make them available for public inspection.

#4 - None of the entities involved appear to be in sync with one another. Public, or other documents obtained clearly demonstrate contradictory language of the benefits of the project not only within each involved organization, but also among the involved organizations. To wit, Clallam County asserts in their public website for the project that one of the benefits of the project is aquifer re-charge, yet in the public meeting we were clearly told that it is not a benefit due to the design that doesn't allow water to permeate soils at a rate sufficient to do so.

#5 - Any non-public entity involved in this project needs to make any and all materials related to this project available to the public for inspection from now until the end. 

#6 - This project should, after a single entity is designated as being responsible to manage it and has authority over other involved entities to abide, be remanded to a full re-start. Current progress should be discontinued until an orderly process methodology is in place, and public concerns have been addressed at each identified stage of the project.

In short, what I am providing is a framework that allows FEMA to best support the citizens affected by this project. If FEMA asks for citizen input, but the citizens are unaware of information they should have access to, how can FEMA be effective at this request to direct all questions and concerns to them?

BTW, wouldn't a large reservoir seep not only into the soil below, but into the subterranean fault, providing lubrication to both and increasing catastrophic events in an earthquake? Not only is the earthen dam more likely to fail as it becomes saturated, but the dormant fault is more likely to slip in a seismological event. It doesn't give me great comfort if I were downhill of that.

Exactly NOI That was why I was concerned about liquefaction and (saturation) of the soil on an earthen damn NEXT to a fault line??? Liquefaction was never acknowledged nor addressed in any of the "reports." but there has been studies and report indicating earthen dams have an extremely high rate of failure in earthquakes and Washington State has an extremely high risk of earthquakes. Besides "earthen" does not tell anyone what type of soil or blends that are to be used to build the damn thing! Sand? Rocks? Clay? Composted soil? Cow patties?

I am only pointing a finger at one tribe, our Jamestown S'Kallam tribe. They are way too powerful at this point and have quietly flown under the wire.

I can only image the time, research, family hours and sleepless nights Jeff has given up to organize incomprehensible happening into organized writings. I take my hat off to you Mr Tozzer!

Good news. The PNPTC clearly states what they are doing is to benefit everyone and they are looking out for everyone's best interests. From their website, last sentence. I tend to be suspicious of someone else telling me they are looking out for my best interest, when there's no definition what my (our) best interest is or that I get to be involved in providing input what that definition is.
