Yesterday, Delorme of the Clallam County Water Conservation Commission stated the Tribe had a treaty right to the water in the Dungeness. She said it was about farming but they had a water right by treaty.
Another man said the ditches were not meant to replenish wells. Yet the SERN workshop talked about wells and restricting them. Now I am even more confused about the Dungeness policy..
They refused to answer the differences in policy from river to river. This is a permanent thing. They have no interest to explain themselves. I will ask again the next time they meet.

The treaty states they have fishing rights on the mouth of the hood canal. I didn’t read they had water rights to every river, but even if they did, fishing rights and water rights are not the same thing. And they must have permission from land owner, if off their reservation. The treaty is not that long of a read, I would recommend everyone to look into it. It’s called the Point no Point treaty of 1855, I believe. You can google it.

The Dungeness is a navigable water. That means the feds are in charge. It is only blocked by salmon hotel logs that are not effective spawning grounds at that point of the river.. Its the amount of fine silt and slow moving deeper water in meandering sections The corps has adopted a system of salmon restoration that says the salmon look for a slow meandering spot with inches of silt. All of the smartest Kings men got together and they wrote their whole perfect salmon spawning diagram in 2003. The Army Corps of engineers signed off on it. They called it natural. It looks like a coil on the back of a refrigerator. They filter it with "baffles" and reject the extra tributary model (real natural) because of....wait for it...riffles. They keep the coil clear of logs. All the logs are required to be felled upstream in useless high grade with high CFS and tragic bed scour. (More on that in the fish culvert). And felled slowly to boot. They did not want a bunch of logs scouring the bed. Overtime their slow moving coil fills with silt and becomes a natural salmon factory. Boy did they crow in the barnyard.

I would suggest writing all three Commissioners with the keys on your computer, ask your questions & demand answers. Zoom is another way to be involved and get your voice heard, you only get 3 minutes, but 3 minutes add up when there are 20 people, 30 people, etc. Add the zoom app onto your phone, iPad, or device, then go to Clallam County Commissioner’s agenda & use the posted zoom address & password to gain access to the meetings on Mondays and Tuesdays. The more people the better, education & action = change.
Yes the Commissioners meet every week, work sessions on Mondays no public comment, Tuesday Board Meeting 3 minute public comment….hope you’ll contribute.

If you were actively using the irrigation water right and paying dues they tap the pipe as part of the service (in our area, Carlsborg) but if you were not active in it then you have to pay (not DIY, contractor rates) to have it tapped. It cost $3000 6 years ago and we were able to split that with neighbors...

It seems logical to me that benefactors of the reservoir project pay for that benefit on a pro-rata use basis. Presumably that payment would be through their existing water usage system. For those on unmetered wells meters will need to be installed so a fair percentage can be paid for recharging aquifers. That would address both agricultural and private usage. Regarding the statement that improved fisheries benefit everyone is not correct. Under current law 50% of the harvestable fish are a treaty tribal allocation. Accordingly, fair cost allocation for reservoir water used to maintain minimum flow levels mandate treaty tribes pay 50% of that cost plus a minimal additional percentage for their personal usage equivalent to non-tribal users. The Ozias / tribal relationship can fairly be called corruption. The best solution would be to remove Ozias from his position of influence BY NOT VOTING FOR HIM.

What we need is a discourse based on factual, transparent and agency accountable information.
The only water source for the basin is the precipitation that falls as either rain or snow. This precipitation is the only basis for all of our water sources, both surface and groundwater, that we depend on. It is a possibility that the water rights and uses that have historically guided the access to this resource are insufficient and inappropriate to service all of the future needs for water. The optimal solution is to treat the entirety of issues as an interconnected and interactive water system. Eventually we will be forced to determine which of the projected and competing water needs should prevail as a priority over the others. However, every seemingly simple decision is interconnected to all of the other options because it has a correlated impact on another intended use, making simple decisions irrelevant. The game of zero-sum water cannot be played without producing winners and losers. Deciding on winners and losers before doing the hard work of analysis is nothing short of bias, at best, and bigotry or greed, at worst.
Consider an example of the interconnectedness of water decisions. Increased development requires additional water resources; reducing river flow directly impacts fish and other wildlife; piping irrigation ditches reduces natural shallow aquifer recharge; farming requires irrigation water; climate changes impact the plant maturation cycle as well as altering the timing of peak surface water flows; unaudited and haphazardly applied conservation methods can be ineffective and divisive; etc. etc.
Change is difficult to achieve because it impacts paradigms and always requires too much time. Change that satisfies all vested interests is unlikely in a water scarce world. Change has a huge cost during the same period of time that funding is becoming more competitive and expensive. Perhaps the most difficult reality to accept is that climate change doesn’t give a damn about human frailties or needs.
A cohesive, nuanced, in depth, expert planned process is needed. It is needed now.
In the point no point treaty, it states that Indians have the right to fish and picks berries on open land, but it was supposed to be used to feed their tribes only… not for trade. The treaty states they are not allowed to trade in Vancouver island or anywhere in our state. They don’t eat fish for every meal. We have grocery stores now to purchase food. The Dungeness is a navigable water. That means the feds are in charge. It is only blocked by salmon hotel logs that are not effective spawning grounds at that point of the river.. Its the amount of fine silt and slow moving deeper water in meandering sections The corps has adopted a system of salmon restoration that says the salmon look for a slow meandering spot with inches of silt. All of the smartest Kings men got together and they wrote their whole perfect salmon spawning diagram in 2003. The Army Corps of engineers signed off on it. They called it natural. It looks like a coil on the back of a refrigerator. They filter it with "baffles" and reject the extra tributary model (real natural) because of....wait for it...riffles. They keep the coil clear of logs. All the logs are required to be felled upstream in useless high grade with high CFS and tragic bed scour. (More on that in the fish culvert). And felled slowly to boot. They did not want a bunch of logs scouring the bed. Overtime their slow moving coil fills with silt and becomes a natural salmon factory. Boy did they crow in the barnyard.
Now you all know why Randy Johnson of Jamestown had to cough the rest of his way his Dungeness webinar after I came on and started writing about all this. One of the people that drew a diagram for consideration for the "perfect ""natural" salmon recovery system with the Corp. Now you know why Randy Johnson could only resort to email attacks to Cathy Lear. Now you know why I am a crackpot.
Write the Corp tell them there is inconsistency and unfairness and you want them to take back control over navigable waters..

This is really sounding like the tax payers of Clallam county will again be in fight for our rights here. So the tax payers who benefited from the open irrigation ditches no longer have access to the irrigation or what is the piping doing to their water use. Wasn’t the reason for the irrigation so that the farmers and residents could have easy access to that water?? And If you own a well seems it will either go dry (because if reservoir) or be metered by the city?? Man I love this area but this is getting ridiculous!! I’m going to be doing all I can to get my back to allow me to move around easier as i want to be more involved in what they are trying to do with our tax dollars and our county. And why do we need a company from Switzerland ( and we are paying them?) involved in our county business and again is this something the tribe will be benefiting from? If so does more of the country tax dollars decrease because of it. I might be loosing the ability to keep up as there is so much happening to us that just isn’t right! Guess I better start taking notes from everything and listing it all down from all of these articles then make my computer put everything in chronological order or group everything by water land purchases stuff like that now I just need to ask somebody how I do all that because otherwise I don’t see any other way of keeping track of all the happening to us I’m getting too old. lol but this is all exhausting. And very maddening.
AI tools would make that pretty easy to do. They can process a lot of data very quickly. The main issue I see is a political will issue. The liberal establishment continues to steer the conversation and has secured their ability to declare what is culturally relevant. Until that changes, there will be no serious opposition to these types of efforts.
I totally agree. It’s making things very difficult and they trying to take everything away from the people, the taxpayers who pay their wages and I don’t like it. I mean, I don’t like it all. I never have liked it and now it’s spreading all over our county as well. They aren’t gonna decide what’s happening to me and the money I give them we have voted on, other than these backyard deals and hiring of outside interests which shouldn’t be happening. I think I need to have a better saying this and i’ve gotta figure out how to get my broken body things to drunk driver to be able to get out more so I can attend the meetings or at least figure out how to do the zoom thing so I can attend that way I guess you can send in questions that way too and hopefully they answer them if you send them in I don’t know. I did read somewhere where Jeff said that they’re no longer taking questions and answers during their committee meetings. That’s bull too! I think they l better listen to what we’re saying or you know maybe we’ll just stop paying taxes I would do that wouldn’t bother me. I would suggest writing all three Commissioners with the keys on your computer, ask your questions & demand answers. Zoom is another way to be involved and get your voice heard, you only get 3 minutes, but 3 minutes add up when there are 20 people, 30 people, etc. Add the zoom app onto your phone, iPad, or device, then go to Clallam County Commissioner’s agenda & use the posted zoom address & password to gain access to the meetings on Mondays and Tuesdays. The more people the better, education & action = change.

They don't answer questions because they don't have to...there is no one 'above' the commie-isioners to hold them accountable and they have had their way for so long... it's like a bad cancer...dangerous and difficult to remove. If you were actively using the irrigation water right and paying dues they tap the pipe as part of the service (in our area, Carlsborg) but if you were not active in it then you have to pay (not DIY, contractor rates) to have it tapped. It cost $3000 6 years ago and we were able to split that with neighbors...
However, the bigger issue is that these NGO's both domestic and foreign are taking control of the land and water resources on behalf of the globalists by secretive, manipulative, coercive, conspiratorial 'ends justifies the means' tactics...it is a silent almost invisible coup and that is what Jeff and others are helping to elucidate...if we are effective we will probably be labeled a domestic terror group by 'Nozias'.
Another really important aspect is we don't know where our Sheriff is in all this. The NGO activity is unlawful and unconstitutional...the Sheriff is the only gov't entity that could stand up for TRUTH, JUSTICE, LIBERTY BUT HE IS POLITICALLY SILENT!

It seems logical to me that benefactors of the reservoir project pay for that benefit on a pro-rata use basis. Presumably that payment would be through their existing water usage system. For those on unmetered wells meters will need to be installed so a fair percentage can be paid for recharging aquifers. That would address both agricultural and private usage. Regarding the statement that improved fisheries benefit everyone is not correct. Under current law 50% of the harvestable fish are a treaty tribal allocation. Accordingly, fair cost allocation for reservoir water used to maintain minimum flow levels mandate treaty tribes pay 50% of that cost plus a minimal additional percentage for their personal usage equivalent to non-tribal users. The Ozias / tribal relationship can fairly be called corruption. The best solution would be to remove Ozias from his position of influence BY NOT VOTING FOR HIM.
If we wait that long...we are in deeper trouble than most want to entertain!

Maybe possible lawsuits coming towards clallam county because of ignorant wreckless decisions by elected officials for various issues,one particular issue that has been going on for many years is the agnew irrigation ditch that used to have year round water but has been dry in many areas for many years but county still charges property owners tax $$$ for a dry ditch.Charging services for items not rendered is inappropriate and if a judgement came down in favor of residents for the many years it would be a big expensive payout for greedy ignorant county for knowingly willingly to collect $$$.Savvy city-county attorneys are supposed to keep lawsuits from coming their way by making sure wreckless ignorant elected do not make stupid mistakes like the city of Cle Elum wa that is on the verge of bankruptcy because of elected official mistakes.
Maybe they're making decisions based on perceived risk. Maybe our elected officials don't think anyone will hold them accountable in a court of law.

I keep saying that we wouldn't have a salmon problem if it wasn't for the wanton, limitless decimation of salmon populations by the Tribes! If they followed the same regulations the rest of us face, there would be plenty of salmon for everyone, without removing green-energy producing dams.

When discussing the state of water resources in the Dungeness Basin, it is not sufficient to continuously focus on particular deficiencies or the lack of adequate planning without also acknowledging that the issue of future water sufficiency in Clallam County is actually very complex and nuanced. Highlighting perceptions that favor a particular ideological point of view or which reflect the financial and political goals of self-serving agencies do nothing more than obfuscate the reality that Dungeness River Basin water is a complex, zero sum commodity, that is more likely to undergo severe stress in our future. The 28 mile long Dungeness River is not a resource that should be the focus of water rights disputes. The Dungeness River capacity should be viewed as serving the same function that the “canary in the coal mines” did for early miners. There is simply no place for “blame” as there is false or misleading information associated with most of the perceptions about this issue. What we need is a discourse based on factual, transparent and agency accountable information.
The only water source for the basin is the precipitation that falls as either rain or snow. This precipitation is the only basis for all of our water sources, both surface and groundwater, that we depend on. It is a possibility that the water rights and uses that have historically guided the access to this resource are insufficient and inappropriate to service all of the future needs for water. The optimal solution is to treat the entirety of issues as an interconnected and interactive water system. Eventually we will be forced to determine which of the projected and competing water needs should prevail as a priority over the others. However, every seemingly simple decision is interconnected to all of the other options because it has a correlated impact on another intended use, making simple decisions irrelevant. The game of zero-sum water cannot be played without producing winners and losers. Deciding on winners and losers before doing the hard work of analysis is nothing short of bias, at best, and bigotry or greed, at worst.
Consider an example of the interconnectedness of water decisions. Increased development requires additional water resources; reducing river flow directly impacts fish and other wildlife; piping irrigation ditches reduces natural shallow aquifer recharge; farming requires irrigation water; climate changes impact the plant maturation cycle as well as altering the timing of peak surface water flows; unaudited and haphazardly applied conservation methods can be ineffective and divisive; etc. etc.
Change is difficult to achieve because it impacts paradigms and always requires too much time. Change that satisfies all vested interests is unlikely in a water scarce world. Change has a huge cost during the same period of time that funding is becoming more competitive and expensive. Perhaps the most difficult reality to accept is that climate change doesn’t give a damn about human frailties or needs.
A cohesive, nuanced, in depth, expert planned process is needed. It is needed now.
In the point no point treaty, it states that Indians have the right to fish and picks berries on open land, but it was supposed to be used to feed their tribes only… not for trade. The treaty states they are not allowed to trade in Vancouver island or anywhere in our state. They don’t eat fish for every meal. We have grocery stores now to purchase food. They sell salmon and shell fish for profit overseas.
The treaty also states they will not cause any harm to citizens, cannot drink spirits on their reservation, and had to free all slaves they had and were pleased that our government saved them from war against other tribes, (not the white man) but their own people.
“Saving the salmon” sounds like such a pleasant thing to do. But what are we saving them from? There will just be more to eat, how is that saving them? There will be more profit from them, is what they really mean.
We have the money to fix the salmon bridges yet ran out of money to finish the road repair by the hood canal bridge. Looks like the dangerous round a bout, will have to wait a few more years.
We'll all be eating red herring in the end. The entire argument about salmon is really about power. Interesting that the JST didn't vote for the opposition to the fish pens like their neighbor tribes did, because, money. Few articles online report the JST opposition, none call out the hypocrisy yet are happy to herald the "unity" of the tribes for that DNR vote decision with Hilary Franz.
All of these highly suspicious and extremely questionable "alliances", especially "global alliances" with foreign entities that have absolutely no honest or lawful business in domestic American matters, should give ALL of the folks in our community reason to be seriously alarmed~! I texted in a badly eroding bank on the Dungeness a few months ago and the County Road Dept. was ON IT in a matter of hours, riprapping and saving the road and a lot more expense later on. This is how government can and should work. Kudos to the REAL government workers who actually serve us!
Let them do their jobs and get rid of useless bureaucrats and ban them from any work interfacing with government policies or activities.
